Terms and conditions of sale

Any order placed by the buyer implies full and unreserved acceptance of these Terms and Conditions of Sale.

1. Scope and seller

These terms and conditions of sale apply to all orders placed on monmatcha.ch. By placing an order, the customer accepts the terms and conditions in force at the time of the order.

The monmatcha.ch website is operated by MonMatcha.ch, which can be contacted by email at info@monmatcha.ch.

In these terms and conditions, "MonMatcha" refers to the seller and "customer" to any person placing an order.

2. Products and prices

Prices are shown in Swiss francs (CHF). For deliveries outside Switzerland, they may be shown in euros (EUR).

Prices in CHF are final prices: MonMatcha is not registered for Swiss VAT. Prices in EUR include all taxes, with no customs duties or import charges to pay on delivery. Delivery costs are shown before the order is confirmed.

Photos are for illustration only. Matcha and tea are natural products: their colour and taste may vary slightly from one harvest to the next. Handmade bowls and accessories may show small differences in shape or glaze, which do not constitute a defect.

Offers are valid while stocks last. In the event of an obvious pricing error, MonMatcha may cancel the order and refund any amount already paid.

3. Orders

The contract is concluded when MonMatcha sends the customer the order confirmation email. The customer checks that their contact details and delivery address are correct.

If an ordered product is no longer available, MonMatcha will inform the customer without delay and refund the corresponding amount, or offer an equivalent product with the customer's agreement.

4. Payment

Payment is made when the order is placed, by credit or debit card (via our payment provider Stripe) or by Twint. Twint is only available for payments in CHF. Business customers may pay by invoice (see article 11).

MonMatcha may refuse a payment method or require payment in advance, without having to give a reason.

The goods remain the property of MonMatcha until they have been paid for in full. In the event of late payment, MonMatcha may charge default interest of 5% per year and reminder fees of up to CHF 20.– per reminder.

5. Delivery

Orders are shipped by Swiss Post to the address provided by the customer.

  • Switzerland: free delivery within 2 working days for orders placed by 4 pm.
  • Europe: flat delivery charge of €1.80 per order, with no customs duties or taxes to pay on delivery. Delivery time: 3 to 6 working days.

Skeeze Matcha: shipped on Mondays only. If other items are ordered at the same time, they are sent with it on the Monday, unless the customer requests a separate shipment.

These delivery times are indicative and are not guaranteed. MonMatcha does its utmost to meet them, but events beyond its control (strikes, bad weather, Swiss Post overload, etc.) may delay a delivery. A delay does not give rise to any claim for damages.

Risk passes to the customer as soon as the parcel is handed over to Swiss Post. If a parcel is returned to MonMatcha because the address is incorrect or it was not collected, the cost of re-shipping is borne by the customer.

6. Inspection on receipt and complaints

The customer inspects the goods on receipt. A damaged parcel, a missing product or a visible defect on an accessory must be reported within 7 days of receipt, by email, with photos of the product and packaging. For a quality defect in matcha, the 4-day period in article 7 applies.

After this period, the goods are deemed accepted, except for hidden defects, which must be reported as soon as they are discovered.

7. Matcha quality, returns and exchanges

MonMatcha.ch is committed to the exceptional quality of all its matchas.

If a packet of matcha appears defective or is unsatisfactory, the customer should contact MonMatcha.ch by email or phone within 4 days of receipt. Each case is assessed individually: an exchange only takes place with MonMatcha.ch's agreement.

Swiss law does not provide a right of withdrawal for online purchases. MonMatcha nevertheless accepts returns under the following conditions:

  • Accessories (bowls, whisks, spoons, whisk holders, milk frothers, sets): may be returned within 14 days of receipt, with prior agreement by email. The product must be new, unused, complete and in its original packaging.
  • Matcha and teas: except in the case of a quality defect (see above), they cannot be returned or exchanged, for reasons of hygiene and food safety.

Any return costs and risks are borne by the customer. After inspecting the returned product, MonMatcha issues a credit note for 90 to 100% of the price paid, which can be used on monmatcha.ch. Return shipping costs paid by the customer are not refunded.

Returning the goods is not always necessary: if the photos or videos of the defect sent by the customer are sufficient, MonMatcha may decide not to ask for the product to be returned.

8. Organic farming

Our ceremonial matchas are certified organic.

  • Inspection body: CH-BIO-006
  • Certificate: BVH-61989
  • Compliant with the Swiss Organic Farming Ordinance
  • Compliant with the EU organic regulation
  • Compliant with the Japanese organic standard

The certificate can be viewed on Easy-Cert.

9. Warranty and liability

If a product is defective on delivery and the defect has been reported within the time limit (article 6), MonMatcha will replace or refund it, at its discretion.

Not covered: normal wear and tear (for example the tines of a bamboo whisk), breakage caused by dropping, and use or care that does not follow the instructions.

MonMatcha's liability is limited to the purchase price of the product concerned, except in cases of intent or gross negligence.

10. Loyalty programme

Customers who join the loyalty programme receive 70 points on sign-up, then 1 point for every franc spent. Points can be exchanged for a discount:

PointsDiscountMinimum order
150CHF 10.–CHF 10.–
200CHF 20.–CHF 20.–
250CHF 30.–CHF 30.–

Points have no cash value and are not transferable. MonMatcha may change or end the programme at any time.

11. Business customers

Prices and conditions for business customers (restaurants, cafés, resellers, partners) are set by written agreement. Unless otherwise agreed, their invoices are payable within 10 days net, without discount. These terms and conditions apply to anything not covered by that agreement.

12. Data protection

MonMatcha processes customers' personal data in accordance with the Federal Act on Data Protection (FADP). It is used to process orders, deliveries, payments and the loyalty programme.

For these purposes, it is shared only with the service providers concerned, in particular Swiss Post for delivery and Stripe for payment. It is never sold. The newsletter is only sent with the customer's consent, and they can unsubscribe at any time.

13. Final provisions

MonMatcha may amend these terms and conditions at any time. The applicable version is the one published on monmatcha.ch at the time of the order.

If any provision of these terms and conditions is void or unenforceable, the remaining provisions remain valid.

Contracts are governed by Swiss law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is the registered office of MonMatcha.ch, subject to mandatory places of jurisdiction provided by law, in particular for consumers.

Anything not covered by these terms and conditions is governed by Swiss law, in particular the Swiss Code of Obligations.
